The Onondaga County Public Library seeks to make resources available and useful to the public.  Through this Website, the Library offers public access to a broad range of information, including historical materials that may contain offensive language or negative stereotypes.  You should view such materials in the historical context in which they were created.   All historical media are presented as specific, original artifacts, without further enhancement to their appearance or quality, as a record of the era in which they were produced.

Any legal action brought against Onondaga County or the Library shall be governed by the laws of the State of New York without regard to its conflicts-of-law rules.  Any claim asserted against Onondaga County or the Library shall be heard and determined in the federal or state courts located in Syracuse, New York.  Users of this Website agree not to commence any litigation relating to the use of this Website, except in courts located in Syracuse, New York.  Users of this Website also waive any objections to venue of any such litigation in courts located in Syracuse, New York and agree not to plead or claim that Syracuse, New York is an inconvenient forum.


PRIVACY POLICY

The Library is strongly committed to protecting the privacy of its online users, customers, members, donors, and friends.  We believe that maintaining privacy on the Web is very important, and that informing our visitors about the types of information we collect and how we use it is crucial.

Type of Information Collected

The Library does not collect any “personally identifiable information” about individuals- such as names and postal or e-mail addresses – except when such information is voluntarily submitted by the user.  Personally identifiable information might be obtained from online transactions such as purchases, registrations, or membership pledges.  Additionally, personally identifiable information may be transmitted in connection with other activities, services, or resources made available on our site.

In common with other Websites, the Library’s Website automatically logs certain “non-personally identifiable” information about visits to our Website.   This information is used for system administration and for producing usage statistics.

How the Information Is Used

Any personally identifiable information provided to the Library is maintained by and accessible only to the Library unless the Library explicitly states otherwise.  The Library will not release information on the use of specific Internet or Website resources by members of the public except as required by law or necessary for the proper operation of the Library.

Third-Party Partners

The Library has teamed up with reputable third-party vendors in order to provide certain services to its online users.  In cases when users leave the Library’s site to visit one of its partners’ sites, users must become familiar with the privacy statements of each site they visit.

Security

The Library attempted to have all reasonable physical, electronic, and managerial measures in place to prevent unauthorized access to the information we collect online.  We do not, however, claim any responsibility for information collected by or from Websites linking to or from the Library’s Website.

Cookies

INTERNET USE POLICY

The Internet is a worldwide network of computer networks.  It is comprised of thousands of separately administered networks of many sizes and types.  Each of these networks is comprised of as many as tens of thousands of computers.

The Library (hereinafter “OCPL” or “Library”) offers access to the Internet to provide an electronic means of reaching ideas and information, greatly expanding its information resources and services.  OCPL will offer access to all users (provided that the rules of this policy are not willfully violated by any such user) and will create materials that will lead them to interesting and useful Internet destinations and resources.

The Library Board of Trustees subscribes to the principles of free speech and expression embodied in the First Amendment of the U. S. Constitution and New York State Constitution.  These principles allow for the free exchange of ideas, some of which may be considered objectionable by some members of the general public.  Accordingly, Library users should be informed that some material accessible on the Internet may contain information/content that is illegal, defamatory, inaccurate or potentially offensive to others.  OCPL cannot be responsible for the information/content found on the Internet, nor can we assure that users will not access objectionable material.  We recognize parental rights and responsibilities in this regard and strongly recommend that parents and/or guardians closely supervise (and/or restrict) their children’s use of the Internet while at the Library.

Rules Governing Use

It will be considered a violation of this Policy for a Library patron to engage in the following conduct:

a.       Abusive or harassing conduct.

b.      Intentionally viewing, downloading, or trading material which is obscene, as defined by law.

c.       Any criminal or otherwise illegal conduct.

d.      Any copyright infringement.  Users are required to comply with all licensing and copyright regulation that may apply to systems or software.

e.       Damaging, disabling or otherwise interfering with the operation of computers, computer systems (including, but not limited to, altering the existing computer settings or filenames), software or related equipment through physical action or by electronic means.

f.        Downloading, installing or using software not expressly authorized by OCPL.

Linking to the OCPL Website

The Library requests that your link to the Library’s Website be presented in a manner that does not give the impression that the Library is making an express or implied endorsement of any good or service provided on your Website and that the link is presented in a manner that clearly indicates that the user is leaving one site and accessing another.

Compliance

The OCPL Administration is authorized to develop rules for appropriate use of the Internet at the OCPL.   Regardless of whether a rule is specifically listed herein or in the Administration’s rules, if the user’s conduct while using the system disrupts the Library or its computer network, it will be considered a violation of this Policy and appropriate action will be taken against the violator, as provided for in the OCPL Patron Relations Manual and/or as set forth in other Board Policy(ies) governing patron behavior.  Federal, state and/or local law enforcement agencies may also be contacted where the violation involves criminal activity.

Onondaga County and the Library specifically retains any rights, including any copyright or other intellectual property rights, which the County and Library may have in any data, databases, files, or images contained in this Website.

It is your responsibility to determine and satisfy copyright or other restrictions when publishing or otherwise using materials created or provided by the Library, including this Website, data, databases, files, or images.  In addition, permission and possible fees may be required from other copyright owners independent of the Library or County.  It is the researcher’s obligation to determine and satisfy copyright or other use restrictions when publishing or otherwise distributing materials found in the Library’s collections.  Transmission or reproduction of protected items beyond that allowed by fair use requires the written permission of the copyright owners.  Researchers must make their own assessments of rights in light of their intended use.
